Every Child Is A Genius LLC (hereinafter referred to as “we,” “us,” or “our”), respects your right to privacy and complies with the Children’s Online Privacy Protection Act (COPPA), as well as other applicable federal and state data protection laws in the United States. We are providing this Notice to inform you, as the parent or legal guardian of a child (hereinafter referred to as the “Parent”), about our information practices concerning children, and to obtain your affirmative consent, as further described in this Notice.

Although COPPA requires parental consent only for children under the age of 13, we choose to obtain parental or legal guardian consent for all children under the age of 16 in order to provide better protection for the privacy of children's personal information. This Notice provides you with a summary of how and for what purposes your child’s personal information will be collected, used, and stored, and how you can provide your consent for such practices.

The types of personal information we intend to collect from your child include: full name; date of birth; gender; video recordings of your child’s testing session, which will capture their responses, actions, interactions, and behavior during the assessment; images and audio files extracted from those video recordings; and your child’s biometric data in the form of facial embeddings, which cannot be used to recreate the original facial image (hereinafter referred to as the “Personal Information”).

We can use your child’s Personal Information for the following purposes:

Provision of the Service. We use the Personal Information to provide the Service you have requested from us, to evaluate and improve the Service, and to deliver individualized accurate testing results.
Creation and Maintenance of the Child’s Account. Personal Information is necessary to create your child’s account under the Parent’s account. It is stored in our system to ensure the provision of the Service and to simplify your return to the Service. This allows you to use the Service again without re-entering information and enables quicker processing of new orders that are appropriate for your child’s age or adding additional options in the future. For example, this could include participating in further testing at an older age within the next age category of tests or accessing new services.
To Ensure Security and Prevent Fraud. For example, to protect the security of our Service and your accounts, to prevent loss, unauthorized access, or disclosure of Personal Information, and to detect and prevent fraud and other forms of misuse of our Service, violations of any laws, regulations, or policies, as well as breaches of our Service’s terms or policies.
Child Identity Verification. Personal Information is required to verify the identity of the child. For example, to ensure that the same child completes the testing from start to finish.
For Legal Purposes. For example, to comply with our legal obligations, ensure adherence to legal or regulatory requirements, and protect the rights, privacy, security, or property of our users, Every Child Is A Genius LLC, or third parties.
To provide you with support and assistance in connection with your use of our Service.For example, to troubleshoot technical issues and provide customer support when necessary.
For the Development and Improvement of Our Service. For example, to develop new features or improve existing features of the Service and to train our AI models.

We will not use your child’s Personal Information for any other purposes without your additional consent.

For the purposes described above, we may share certain reasonably necessary Personal Information with:

(i) our service providers and contractors, solely to perform limited functions on our behalf. These parties who are capable of maintaining the confidentiality, security and integrity of such information, and who provide assurances that they will maintain the information in such a manner;
(ii) for legal purposes, including disclosure to government authorities where required by law;
(iii) to affiliated companies or in connection with the transfer of business. We do not disclose Personal Information to such parties for their own commercial or marketing purposes.

We do not engage in “profiling” that uses your child’s Personal Information to make automated decisions that produce legal effects or similarly significant consequences.

We do not sell, trade, lease, or otherwise profit from a child’s Personal Information (including biometric data) to any third party. We also do not share, transfer, or grant access to such information for monetary or other valuable consideration (as defined under COPPA and other applicable laws).

We do not make a child’s Personal Information publicly available, nor do we disclose it to third parties for the purpose of contacting the child, including through behavioral advertising, or for building a profile on the child.

We will retain Personal Information for as long as necessary to fulfill the purposes outlined in this Notice and our Privacy Policy, unless a longer retention period is required to comply with legal obligations, regulatory requirements, or for security purposes. Personal Information will be stored on secure servers with reasonable security measures in place to protect it from loss, misuse, unauthorized access, disclosure, alteration, or destruction. These measures include, but are not limited to, encryption, de-identification or anonymization where appropriate and feasible; and the deletion of data that is no longer necessary. Biometric data will be retained only for as long as necessary to fulfill the purposes for which it was collected, or no longer than the period required under applicable U.S. state laws.
